Cybersquatting Lawsuits In Federal Courts Under the Lanham Act and Anti-Cybersquatting Consumer Protection Act (ACPA):

Domain Tasting Defendants Respond to Dell Cybersquatting Lawsuit – Defendants has responded Juan Pablo Vazquez to the Dell ACPA / Cybersquatting / Typosquatting / Domain Tasting Complaint. CyberLaw Professor John Levine correctly notes that Defendants have failed to offer much substantive in defense to the Dell domain tasting and cybersquatting lawsuit.

Domain Tasting is Bad for The Internet, Domaining and ICANN’s Credibility - The Dell lawsuit has the potential to put the practice of domain tasting on the front page, as has already occurred when its lawsuit which was picked up by the Washington Post. Will Dell and its friends in the trademark rights world take advantage of this unique opportunity? Will they take this opportunity to educate the public and other corporations about the largely invisible practice of domain tasting and cybersquatting? This cybersquatting lawsuit focuses the spotlight on domain tasting practices, which have largely gone away since a revision in ICANN policy.

Verizon v Navigation Catalyst Cybersquatting Lawsuit Settled: NCS Continues to Cybersquat Trademark Protected Domains – Despite the cybersquatting lawsuit brought by Verizon, Navigation Catalyst continues to target and register trademark protected domains and famous brands, as noted below in a recent panel decision against it under the UDRP wherein it was found to have engaged in bad faith cybersquatting on 41 domains of another famous brand. Is it time Navigation Catalysts automated registration software, which clearly targets high traffic and likely trademark protected brands, be enjoined for the good of the domainer community?

Domain Taster’s Days Are Numbered: ICANN Marches Forward With Changes to AGP – “Arbitrators like the World Intellectual Property Organization and the National Arbitration Forum attribute the record number of international trademark disputes last year to domain tasting. Since this form of domain name tasting emerged in 2005, for example, the number of disputes to come before the WIPO has risen 48 percent, to 2,156.” International Herald Tribune, April 27, 2008.

Microsoft Sues Dentist for Cybersquatting And Trademark Infringement - Microsoft has filed a trademark infringement and cybersquatting lawsuit against a California dentist who has registered more than 40 Internet domains with names similar to the software maker’s trademarks, product names and brands. This appears to be a case where an unsuspecting dentist registered infringing domains knowing nothing about cybersquatting, domain or anti-cybersquatting laws. The cybersquatting complaint is a slam dunk. The dentist registered domains which obviously infringe on Microsoft’s trademarks including: aMicrosoftShop.com, aMicrosoftStore.com, XboxOutlet.info and XboxMarket.mobi.
